Former Hockey Player Wins Negligence Suit Over Wife’s Death

A Former National Hockey Player Has Won A Negligence Suit Against A Doctor From A Private Hospital, Bagging A Total Of RM335,000 In Damages. The Court’S Decision Came After The Player, Avtar Singh, Filed A Claim On Behalf Of His Late Wife, Salinder Kaur, Who Tragically Passed Away After Suffering A Brain Stem Stroke. The Judge, Raja Ahmad Mohzanuddin Shah Raja Mohzan, Awarded RM234,624.09 In Special Damages And RM100,000 In General Damages To Avtar, Along With RM40,000 In Costs. The Judge Justified The RM100,000 General Damages, Considering That The Deceased Was Bedridden For Almost 10 Months Before Her Passing. Raja Ahmad Mohzanuddin Also Pointed Out That The Doctor Had Admitted Responsibility For The Negligence Claims. However, The Court Dismissed The Claim Against The Private Hospital At Kelana Jaya, Ruling That The Hospital Did Not Owe A Non-Delegable Duty Of Care To The Plaintiff Or The Deceased. Avtar, Who Had A Successful Hockey Career, Had To Put Aside His Personal Interests, Including Coaching, To Take Care Of His Wife After The Tragic Incident. The Lawsuit, Filed In 2019, Highlighted That Salinder Was Not Properly Diagnosed Due To The Doctor’S Alleged Negligence And The Lack Of Proper Medical Equipment At The Hospital. This Unfortunate Incident Led To Salinder’S Transfer To Another Hospital, Where She Later Passed Away.
